Stop The Madness: 5-10 Seconds Gets A Man Years In Jail
The state’s(Maryland) highest court ruled yesterday that a man can be charged with rape if he ignores a woman’s calls to stop - even if she had previously consented to sex.
“[So] are you going to let me hit it?” he said, according to police. “I don’t want to rape you.”
The victim testified in Montgomery County court that she agreed to sex “as long as he stops when I tell him to.” As he(Baby) began, she told him to stop because he was hurting her, but he kept going for five or 10 seconds, she said.
Baby denied any wrongdoing but was convicted of first-degree rape and other crimes and sentenced to 15 years in prison, with all but five suspended.
This kid got charged with first degree rape over 5-10 seconds of sex after she said to stop. Even though she consented to initiate sex and he did comply after a very short delay, the man faces years in jail. So basically any bitter female can scream rape on any men and it would be very hard to prove he didn’t do it. She can say he kept going for 2 seconds and he could face 15 years in jail. Do men have to start taping there love sessions to avoid accusations like this? Do ladies have to sign a release contract before things get poppin?

The case is going to a new trial - it has YET to be decided that he is going to go to jail for the same length of time (whether longer or shorter). Hold judgment until then…
If she wanted to “revoke consent”, then that is fine, whatever….but, I think the man should be required to stop within a reasonable amount of time, 5-10 seconds is ridiculous, now if he kept going for even a couple of minutes then I would say he was in the wrong. HEY GUYS I HAVE BEEN READING THE CASE FILE ON THIS TRIAL! And I can give a little more insight on exactly what happened and why this guy was convicted. This article by my boy realtalk is a little misleading.
Baby did not get convicted only because of the 5-10 second rule. Baby did not actually get it in anyway. They did not have sex at all. He tried to put it in and she said it hurt. By his testimony he stated she never said “STOP” that she just got up and said “it wont go in”. Her testimony was that he never got it in and after she said “STOP” he tried to put it in for about 5-10 more seconds then gave up. Which makes this whole 5-10 second assertion even worse because they were not actually having sex.
My opinion on why he was convicted was because of what preseded the sexual encounter. Her testimony throughout trial was that Baby and his friend (who actually did hit it) pretty much imprisioned her in her car (she agreed to give them both a ride to a party; Baby and his friend was this chick’s friend’s brother’s friends). She claims (which seems like bulls*it to me but the jury bought it) that after arriving to the party Baby and his friend decided to not go to the party. And the girl assumed they wanted to be dropped back off at Mcdonalds (where they were orginally).
So according to her when they got back to Mcdonald’s her friend (the other chick) left and now the two boys were in the back seat with her still in the car. She said they CONVINCED her to come into the back seat between them so that they can “TALk”. She does this then immediately the two start grabbing and touching her asking if she would go down on them. She supposedly refused. Then Baby left the car then a few minutes later his boy comes out and says he just hit that. Baby then gets back in the backseat and ask her “are u gon let me hit that?” She states she only agreed because prior the two boys said that she cannot go ANYWHERE until they are DONE. So supposedly wanted to go home she agreed to let the boys do what they wanted to do. This is where I think she won over on the jury causing Baby to be convicted for rape. Like I said my opinion is he was charged not b/c of the 5-10 seconds extra that he tried to put it in. But because the girl felt imprisioned and only agreed to have sex to be allowed to leave.
Now again I still do not see how the hell a jury ever convicted this guy because there were so many questions and problems within her statement.
This girl actually gave Baby her PHONE NUMBER after this encounter happened when he asked her for it. Crazy man!
Looking at the events of this whole trial I really think due to the questionable statements made by the girl and the entire incident. Baby probably at some point will be let off. But like I said from reading the entire case the media seems to be focusing on the 5-10 seconds when I think that had very little to do with why Baby was convicted.

If you look at Baby’s friend who accordng to all counts was allowed to have sex with her. She never said stop. But he pleaded to second-degree rape! I think the attorney in his case believed that with the girl’s account of what caused her to have sex with him that she was imprisioned; he would’ve easily been convicted of rape.
That’s again why I think that Baby’s conviction had othing to do with the 5-10 second rule. Because his friend is serving jailtime too when there was no 5-10 second rule.
I think the media picked up and ran with this 5-10 second rule story because the jury while deliberatiing did ask the judge a question if a female agrees to sex then changes her mind and the guy continues. At what point is it rape? The trial court answered after investigating cases pertaining to the question. By saying any woman who agrees to sex then changes her mind mid-course is not considered rape.
The jury once again posed the same question but this time the judge gave a totally different answer. Saying this is a question the jury has to decide.
So then the jury comes back with a conviction of rape. So now the media is only concentrating on the jury’s question and not the actual events of the whole trial. Personally I do not know why the jury asked the damn question im the first place. Because the defendant and the girl did not have sex anyway. (But sometimes jurys in many cases I’ve seen; get into an argument with each other that may have very little to do with the case. even start bets with each other, then ask the judge to settle the argument. LOL!)
Which I think is what happened in this case. The jury posed a question that had very little to do with the trial, then they asked the question again and the judge changed his answer.
NOW Baby’s attorney is trying to get the case completely thrown out (he has already suceeded in getting it overturned in the appeals court) by the claim that the judge changed his answer and shouldn’t have. Therefore the juror were given incorrect instructions leading to his client not getting a fair trial.
Now as this case is going to higher courts the main argument (and again this is why the media is only talking about this). Was the judge correct in his first answer?
Like I said though this whole debate about the jury’s question to the judge had very little to do with the actual case and why Baby was convicted….
