The problem is that the entire song is based upon the beat, basically only the singing of Nelly and some background choir is not totally based on the song (and even those parts has to obey the harmonics and rythm from the original song), making it possible for the opposing part to make some serious claims and therefore Timbaland and Geffen has probably been hoping that the situation would just go away if they kept quiet about it.
